FSD Hunter Terms of Use

FSD Hunter is owned and operated by FSD Hunter LLC.

FSD Hunter LLC is located in Fort Wright, Kentucky, United States.

These Terms apply to your use of FSD Hunter (the "App" or the "Service").

Important: FSD Hunter provides informational signals about listings that may include Full Self-Driving (FSD), Enhanced Autopilot (EAP), or Acceleration Boost. You must confirm vehicle features with the seller and/or Tesla before purchasing.

1. Acceptance of Terms

By downloading, accessing, or using the App, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of the App

FSD Hunter is an informational tool designed to help users browse and evaluate used Tesla vehicle listings. The App may highlight listings that may include certain Tesla software features, such as Full Self-Driving (FSD), Enhanced Autopilot (EAP), and Acceleration Boost.

The App does not sell vehicles, act as a broker, or participate in vehicle transactions. Any purchase, negotiation, communication, or agreement is solely between you and third-party sellers.

3. Eligibility

• By using the Service, you represent that you are at least 18 years old or are using the Service with the consent of a parent or legal guardian.

4. Informational Use Only

All information in the App is provided for informational purposes only. Listing information and feature indicators can be inaccurate, incomplete, outdated, or otherwise incorrect. The App does not guarantee that any vehicle includes, retains, or is eligible for any specific software feature.

You are responsible for independently verifying all vehicle details, including software features, transfer eligibility, pricing, availability, and current entitlement status, directly with the seller and/or Tesla before making a purchase or financial decision.

5. Tesla Software Features and Changes

Tesla vehicle software features, including FSD, EAP, and Acceleration Boost, are controlled solely by Tesla, Inc. These features may be enabled, disabled, transferred, revoked, modified, or otherwise changed at Tesla's discretion, including due to ownership transfer, account changes, software updates, policy changes, or Tesla determinations.

FSD Hunter LLC has no control over Tesla systems or decisions and is not responsible for any changes to software features before or after purchase.

6. User Responsibility and Due Diligence

• You are responsible for independently verifying vehicle details before making decisions.
• You are solely responsible for conducting your own due diligence.
• You must verify all vehicle features and eligibility prior to purchase.
• Listing data may be incorrect or misleading.
• Software features may not transfer or may later be removed or changed by Tesla.
• Use of the App is at your own risk.

The App should not be relied upon as the sole basis for any vehicle purchase decision.

7. Third-Party Listing Information

Listing information may be derived from automated collection of publicly available data and third-party sources, including dealerships, marketplaces, and public listings. While we attempt to present accurate and up-to-date information, FSD Hunter LLC does not guarantee the accuracy, completeness, or timeliness of any vehicle details, pricing, availability, or features. All vehicle information is provided for informational purposes only and may change at any time without notice. Users are responsible for verifying all vehicle details directly with the seller or dealer before making any purchase or financial decision.

8. User Reports

The App may allow you to voluntarily submit reports about inaccurate, stale, or sold listings. Reports are user-generated and are not independently verified by FSD Hunter LLC. We may limit submissions or remove reports to prevent abuse and maintain service quality.

9. Third-Party Websites and Content

The App may link to third-party websites, including listing pages and seller pages. FSD Hunter LLC does not control third-party sites and is not responsible for their content, availability, or practices. Any interactions or transactions with third parties are solely between you and the third party.

10. Restrictions on Use

• Users may not copy, scrape, reverse engineer, or redistribute data from the app without prior written permission from FSD Hunter LLC.
• Users may not use the App in a way that interferes with service operations, circumvents technical protections, submits abusive or fraudulent reports, or violates applicable law.

11. Suspension and Termination

FSD Hunter LLC may suspend, restrict, or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms, misused the App, engaged in scraping or automated abuse, submitted fraudulent information, created risk for other users, or exposed FSD Hunter LLC to legal or operational harm.

12. Changes to the App or Terms

FSD Hunter LLC may modify, suspend, or discontinue any part of the App at any time without notice. We may also update these Terms from time to time by posting an updated version. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

13. Subscription and Billing Terms

If the App offers paid subscriptions or premium features, billing, renewals, cancellations, refunds, and payment processing are handled by Apple, Google, or other applicable platform providers under their own terms and policies. FSD Hunter LLC does not control platform billing systems and is not responsible for billing errors, refund decisions, payment failures, subscription interruptions, or platform account issues.

Access to subscription-based features may be limited, suspended, or terminated if the applicable platform reports expiration, cancellation, chargeback, payment failure, refund, fraud concerns, or other entitlement changes.

14. No Professional Advice

The App does not provide legal, financial, tax, investment, brokerage, mechanical, or other professional advice. Any information provided through the App is informational only and should not be treated as a substitute for independent professional advice or direct verification.

15. No Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including without limitation warranties of accuracy, reliability, merchantability, fitness for a particular purpose, or non-infringement.

16. Limitation of Liability

• To the fullest extent permitted by applicable law, claims related to the App must be brought against FSD Hunter LLC and not its individual members, managers, officers, employees, contractors, or operators.
• FSD Hunter LLC and its operators are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of the App.
• FSD Hunter LLC and its operators are not liable for damages arising from reliance on listing data or feature indicators, vehicle purchases or transactions, or the loss, revocation, transfer, or modification of Tesla software features.

Unauthorized copying, scraping, redistribution, reverse engineering, or misuse of App data or content may cause irreparable harm to FSD Hunter LLC for which monetary damages may be inadequate. FSD Hunter LLC may seek injunctive or equitable relief, in addition to any other remedies available at law or in equity, to prevent or stop such conduct.

17. No Affiliation

FSD Hunter is an independent service and is not affiliated with, endorsed by, or sponsored by Tesla, Inc. Tesla, Full Self-Driving (FSD), Enhanced Autopilot (EAP), and other trademarks belong to Tesla, Inc.

18. Governing Law and Arbitration

These Terms shall be governed by and interpreted in accordance with the laws of the State of Kentucky, United States, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or use of the App shall be resolved through binding arbitration on an individual basis, rather than court litigation or class proceedings, except where applicable law requires otherwise. The arbitration shall be administered by the American Arbitration Association under its applicable consumer arbitration rules, unless the parties agree otherwise.

Either party may bring an individual claim in small claims court if the claim qualifies. Either party may also seek temporary, preliminary, or permanent injunctive or equitable relief in a court of competent jurisdiction for misuse of intellectual property, unauthorized scraping, unauthorized copying, security abuse, or other conduct that may cause irreparable harm.

You and FSD Hunter LLC agree that any arbitration or proceeding will be conducted only on an individual basis and not as part of a class, consolidated, collective, representative, or private attorney general action.

19. Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

20. No Waiver

No failure or delay by FSD Hunter LLC in exercising any right, remedy, or provision under these Terms shall operate as a waiver of that right, remedy, or provision.

21. Assignment

You may not assign or transfer any rights or obligations under these Terms without prior written consent from FSD Hunter LLC. FSD Hunter LLC may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, asset sale, reorganization, or by operation of law.

22. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and FSD Hunter LLC regarding the App and supersede prior or contemporaneous understandings, communications, and proposals relating to the App.

23. Privacy

Your use of the app is also governed by our Privacy Policy.
